Royal Mail Dispute Leverage Campaign – Letter to all Royal Mail Group Corporate Shareholders

The purpose of this LTB is to advise Branches that the attached letter is being sent to all major corporate shareholders of the Royal Mail Group. The letter explains that despite what has taken place in the court, the union and its members remain totally opposed to the company’s strategy for the future.

The letter also makes it clear that the blame for this dispute lies squarely at the door of the CEO and the Royal Mail Board. Furthermore, the union will invite major shareholders to a meeting where we will set out an alternative vision for the future.

 

In opening up this new flank in our dispute, we believe it will put significant pressure on the employer to reconsider its plans. The union will be seeking media publicity on this development and we are committed to ongoing direct engagement to leverage shareholders and ensure they respond in an appropriate way.

It is important that you make our members aware that the union has opened up this new flank in the dispute. We will shortly be sending out further information, including details of the corporate shareholders we are targeting, and we will be asking individual members to write directly to these shareholders in support of the dispute.

In order to build up the pressure, in the near future we will also be asking the wider public and politicians to take similar actions in support of our dispute.

Finally, please ensure the content of this LTB and the attached letter is widely circulated to all CWU Representatives and members and we would ask that in turn our Reps engage their managers on the actions the union will now be taking.

Dear

 

The Communication Workers Union are writing to all major shareholders in the Royal Mail Group PLC to set out the facts behind our ongoing dispute with the company and explain our next steps.

 

Firstly, we must be clear that despite Royal Mail being granted an injunction to invalidate our strike ballot, the CWU and its membership will continue to do all within our power to oppose the company’s strategy to set up a separate parcels business and allow thousands upon thousands of jobs in the core business to wither on the vine.

 

You should be in no doubt that the CEO and his Board have totally lost the confidence of the workforce and that managers at all levels are now questioning the integrity, commitment and capability of the board to run the business.

 

Following the outcome of the court proceedings, the workforce are now angrier than ever and there is one simple truth that the company cannot face away from; without the support of the workforce it is impossible for Royal Mail to introduce its plan as presented to all shareholders at Capital Markets day in May 2019.

 

The facts behind the dispute

 

The blame for this dispute lays squarely at the door of the CEO and his Board.

 

Shortly after taking up the role, the CEO decided to walk away from two major agreements (The Four Pillars of Security and Agenda for Growth), which the company had made in good faith with the union in 2018 and 2013 respectively.

 

These agreements, overwhelmingly endorsed by the workforce, spelt out the overall plan and strategy on how we would jointly shape the future of the business. Instead, without any prior consultation, the CEO launched his own plan at the Capital Markets Day event. In doing this, the CEO deliberately misled shareholders by claiming the union was on board. This could not have been further from the truth. A fact totally backed up by over 97% of the workforce voting for strike action in a massive 76% turnout.


Next steps

 

The CWU and the workforce will continue to oppose the company’s plans for the future. We can advise you that we are now undertaking the following actions.

 

  • We will engage in meaningful negotiations providing the company agree to set aside their plans to set up a new parcels business. To be clear, to settle this dispute the company must reinstate our agreements as the plan for the future and resolve all the issues advised of in the industrial action ballot.
  • We are ready to re-ballot for industrial action if the company decides to press on regardless or we fail to reach an acceptable agreement.
  • We will be organising a shareholder meeting in London in the near future and we will shortly advise you of the date and venue for this. At this meeting we will explain, in line with our agreements, the alternative vision for the future that will grow the core business, expanding the role of postal workers in local communities and businesses, as well as delivering sustainable parcel growth.
  • We will be mounting a major public and political campaign to expose the shortcomings of the Royal Mail Board and gain support for our alternative vision of the future.
  • We are investigating the basis upon which Royal Mail has added in October 2019, over £470 million of debt to its balance sheet. We believe the reasons for this have not been properly explained to shareholders.

 

In the meantime, we are asking you to write to the CEO raising the issues covered in this letter and urge the Board to cease its unilateral actions and engage in meaningful negotiations to find a mutually beneficial way forward. The Trustee of the Royal Mail Pension Plan (RMPP) is a company called ‘Royal Mail Pensions Trustees Limited’. This company is legally responsible for ensuring that the RMPP is run properly. The Board of Directors of this Company comprises nine Trustee Directors, of whom;

  • one is an independent Chair appointed by Royal Mail Group and Post Office Limited with the agreement of the unions,
  • four are nominated by or on behalf of the membership (three through the CWU process and one through the Unite/CMA process), and
  • four are nominated by Royal Mail Group and Post Office Limited.

One of the member-nominated positions through the CWU process is due for selection with effect from 1 April 2020 and so nominations are now being sought. The position is currently held by Lionel Sampson and we understand that he will be seeking re-election for a new term of office. Nominations can be from any individual who is a current, retired or deferred member of the RMPP, irrespective of Union membership. A self-nomination form is attached which once completed should be returned to the Senior Deputy General Secretary’s department at CWU HQ, by 20 December 2019.

All Candidates will be required to submit a 200-word (maximum) statement supporting their candidature for election to the position when returning their nomination forms.

Individuals wishing to understand the role of a trustee can visit the Pensions Regulator’s website and read the section: ‘An Introduction to Trusteeship’ which is in the ‘Trustees’ tab and then by clicking ‘Understanding Your Role’.

Upon receipt of a nomination, an information pack will be dispatched to the individual who has submitted the nomination. The pack will contain information on the role and responsibilities of a Trustee, a detailed job description and a personal specification for a potential Trustee.

Prior to a ballot taking place all candidates who have submitted a fully completed nomination form will be required to attend a half-day pre-election familiarisation seminar in London on 15 January 2020, which will be organised by the RMPP Trustee. At this stage candidates will be asked to re-confirm that their names should be added to the ballot paper and will also be given the opportunity to make any textual changes to their supporting statement.

If there is more than one valid nomination, a ballot will be held of all individuals who are employee members of RMPP and who are employed in CWU represented grades, irrespective of Union Membership. The ballot will be conducted by the distribution of ballot papers direct to individual home addresses.

Completed ballot papers must then be returned in the envelope that will accompany the ballot paper to Popularis, who have been appointed as Independent Scrutineer for the purposes of this election.

The candidate who receives the most votes in the ballot will be selected as the CWU MND. In the event that there is only one nomination forthcoming then that nominee will be deemed to be selected without the need for a ballot and should there be no nominations at all, the nomination and selection process will be re-run no more than three years later.

Royal Mail Group – 2019 Free Flu Voucher Offer To All Staff Campaign – REMINDER:

Further to LTB 588/2019, issued on the 14 October 2019, this is to remind Branches of the Royal Mail Group – 2019 Free Flu Voucher Offer to all employees and to ask Branch Reps to ensure all members are aware of the offer should they wish to take it up. They have until the 31 December to request a voucher and redeem it at a participating high street Lloyds Pharmacy (or alternative where Lloyds isn’t locally available).

CWU Members can collect a ‘Free Flu Jab Voucher’ from their manager on request. Managers will then print off a voucher for them to take to their local Lloyds Pharmacy branch.  The offer expires on 31 December 2019.

Influenza (flu) is one of our most significant causes of illness during the winter months. Flu is a respiratory illness caused by a virus, which is highly contagious. Royal Mail is offering all of the workforce a free flu jab with the opportunity to receive it at a Lloyds Pharmacy (or an alternative pharmacy where Lloyds are not available in the locality).

To receive your flu jab members simply visit a branch of Lloyds Pharmacy with their voucher and their Royal Mail ID card. It’s recommended that they contact the local branch of Lloyds Pharmacy in advance to make an appointment as demand for the flu jab is currently high. The CWU is encouraging members to seriously consider taking up this offer as in 2017 over 31,000 Royal Mail Group employees were affected by the Flu which was over a 31% increase on the previous year with 127,256 days lost with staff off work sick and very ill with the Flu. ‎The estimated cost to the Royal Mail Group was over £41 million.

Some key points to note are as follows:-

  • New recruits are included in the ‘Free Flu Jab’ scheme.
  • Any member who lives 15 miles or over from a Lloyds Pharmacy can use an alternative pharmacy/chemist shop company which is more conveniently located to obtain their flu jab and they will be reimbursed on provision of a receipt, paid via T&S. Prior authorisation from their manager is required.
  • Temporary contract and agency workers with a contract or service which has exceeded or is expected to exceed 12 weeks are included and can request a Flu Jab Voucher.

Your assistance in supporting and promoting the campaign and raising awareness locally within your Branch and constituency area would be welcomed and much appreciated.
