REGIONAL LEADS – DEVELOPMENT WORKSHOPS

Please be advised that a series of Regional Workshops have been scheduled to assist Regional Secretaries and their respective Regional Leads with the drafting of Regional Development Plans.

The workshop will cover a variety of topics including Trade Union Values, Available Support, and a focussed look into strategic planning including time to discuss key regional priorities.

A key outcome of the event will be to prioritise the composition of an overarching Regional Strategy. It is hoped that the Regional Leads will then be able to cascade the techniques learned through to their individual sub-committees.

The workshops are to be delivered “in-house” and we will be working closely with Regional Secretaries to ensure the venues have adequate access. If any other adjustments are required please notify your Regional Secretary who will also be responsible for forwarding names of attendees to Maxine Todd (mtodd@cwu.org).

Health, Safety & Welfare Proposals – Labour Party Workers Rights Manifesto – General Election 2019 

With the General Election upon us it is only the Labour Party that has given any consideration to the vitally important issue of Health, Safety and Wellbeing at Work. This has been set out in great detail in the “Labour’s Workers Rights Manifesto” section of the Election Manifesto. Within this, a Labour Government commits to bring about the biggest extension of rights for workers that the UK has ever seen, ensuring that making working people’s lives better will be at the heart of what a Labour Government will do in power and will not allow UK law to fall below EU law, something that is a real risk under the Tories.

Making Workplaces Healthier and Safer 

In summary, in relation to health and safety, a Labour Government will:-

• Bring UK law into line with the International Labour Organisation (ILO) Health and Safety Convention standards and the European Social Charter.
• Strengthen enforcement with a new Workers’ Protection Agency.
• Set up a Royal Commission to review the law on health and safety at work to revise the UK’s dated legislation, making it fit for now and the future.
• The Royal Commission will make provision for work stress, mental health, the impact of new technology and new materials, and ensure that injury, illness and death from work is reduced to the minimum and that when it does occur the burden does not fall disproportionately on workers and their families.
• The Royal Commission will make sure every worker has access to basic facilities such as rest and access to toilets and toilet breaks and will review the law to prevent sick or injured workers being unreasonably disciplined or subject to capability procedures as a means to dismissal.
• Overhaul and strengthen the Working Time Regulations 1998 (as amended 2007) and introduce a better work life balance.
• Ensure that public-facing workers are protected by toughening the law against abuse and violence. Requiring employers to create and maintain workplaces and working conditions free from harassment, abuse and violence, including “third party harassment” of workers in public facing roles such as health, retail, bus driving and postal workers.
• Require employers to make reasonable adjustments to assist those going through the menopause.
• Introduce a Government backed Reasonable Adjustments Passport scheme to help disabled people and strengthen Access to Work support.
• Make sure trade union safety reps are able to take enough time off to perform their union-related duties and undertake training.
• Ensure employers uphold their obligations to consult with recognised trade unions and their Safety Reps.
• Introduce a maximum temperature for workplaces.
• Ensure all workplaces are covered by health and safety legislation.
• Examine how health and safety protection for outdoor workers is delivered.
• Put mental health on a par with physical health in workplaces.
• Introduce ‘roving safety reps’ for workplaces.
• Introduce the right for trade union health and safety reps to inspect workplaces and employers other than their own.
• Allow workers to bring civil cases for breaches of statutory health and safety regulation.
• Defend workers’ ability to recover legal representation costs from negligent employers and keep the right for workers to be represented and recover their costs in cases of employer negligence leading to injury at work.
• Strengthen protections for pregnant women.
• Strengthen the protection for whistle-blowers because such actions protect others.
• Increase workplace inspections and prosecutions on workers’ behalf.
• Introduce tougher penalties for employers who break the law or fail to comply with tribunal orders.
• Introduce Directors’ personal responsibilities in law and liability for offences.

POST OFFICE: HORIZON TRIALS – OUT OF COURT SETTLEMENT REACHED

Further to LTBs 669/19 and 676/19 dated 21st/22nd November. An out of court settlement following two weeks of mediation has been announced today in regard to the Group Litigation brought by 557 Postmasters in relation to the Horizon system. The claim against the Post Office was brought by the Justice for Subpostmasters Alliance (JFSA) and involved a number of test cases. 

Whilst we are obviously pleased an outcome has been secured for the long suffering former Postmasters, it is hardly co-incidental that this announcement has been made on the eve of the General Election as I suspect it is likely to be lost by the mainstream media whose focus and attention will be on the voting intentions of the electorate.

At the moment, full details are sketchy and even though a settlement has been reached, the Judge – Justice Fraser is seemingly still planning to hand down his judgement in relation to the second trial on Monday 16th December. 

Attached to this LTB is a Post Office “One Update” from the new Chief Executive Officer Nick Read coupled with a statement in which Nick Read apologises to those affected as follows:

“The Post Office would like to express its gratitude to claimants, and particularly those who attended the mediation in person to share their experiences with us, for holding us to account in circumstances where, in the past, we have fallen short and we apologise to those affected.”

General Conference 2020 – Sunday 19th –Tuesday 21^st April 2020

Attached with this Letter to Branches are motion forms for General Conference 2020. Branches should note that the motion guide for submitting motions to General Conference 2020 has been attached.   Submitting bodies are advised to read the guidance notes carefully prior to submitting motions to ensure your motions meet the criteria for submission.

At this stage it is expected that the Equality Day will be Monday 20^th April 2020.   Whilst it is hoped that the content of motions submitted by the Regions on behalf of the Regional Equality Sub-Committee will be such that it is appropriate to be placed in the Equal Opportunities section of the agenda and heard on the Equality Day,  motions will not automatically be placed there unless the content of the motion allows.

Rules Revision Conference

There is due to be a Rules Revision conference in 2020.    The date and location at this time have not been confirmed and further information will be provided at a later date on this.  There will therefore be no Rules Section at General Conference 2020.

Entitlements In relation to the General Conference 2020:

• All Branches are entitled to submit three motions to General Conference.
• Regional Committees are entitled to submit three motions to the General Conference – however one of the motions must be from the Regional Equality Sub-Committee.
• Regional Health and Safety Sub-Committees are entitled to submit three motions on Health, Safety and Environmental matters to the Health Safety and Environment section of the agenda.

Branches/Regional Committees/Regional Health and Safety Sub-Committees are also reminded that the closing date for the submission of motions to General Conference is 12 noon, Monday 3rd February 2020. 

Motions submitted by email and any other email correspondence must be sent to generalmotions@cwu.org and no other personal email address.

Royal Mail Group (RMG)/CWU Agreement – Mental Health First Aid Training for Physical/Medical First Aiders and CWU Area Health and Safety Representatives (January – March 2020 Course Dates – Applications Now Invited)

LTB 481/18 reported to branches that a major Agreement on Mental Health First Aid Training had been reached by the CWU Health, Safety & Environment Department with Royal Mail Group and as part of the Royal Mail Group, “Because Healthy Minds Matter”, five-year mental health strategy, Royal Mail Group has agreed to up-skill all physical/medical first aiders with Mental Health First Aid (MHFA) training which will involve approximately 5,500 CWU members who are First Aid volunteers across the UK. In addition, all CWU Area Health and Safety Representatives in all Royal Mail Group Businesses and Business Units, approximately 150 CWU Health and Safety Reps, will be included in the programme plus 200 Mental Health Ambassadors, most of whom are CWU Reps and members will be able to attend the MHFA one-day training courses also.

The MHFA training is evidence based and is aimed at increasing people’s mental health awareness, skills and confidence, enabling them to step in to situations where they notice signs of poor mental health and help someone in distress and to give first aid support, talk, and help prevent them from hurting themselves and signpost them to the right professional, expert support.

The training will be provided by in-house, accredited, licensed MHFA instructors. 17 Royal Mail Group trainers have now completed the MHFA England Trainer’s Course. They undertake 6 days of training, then have to run 2 x 2 days MHFA courses on which they are assessed by MHFA England assessors and are then licensed to deliver the training. A MHFA England specially designed 1-day course will be provided and is a condensed version of the standard 2-day MHFA (England) training course. The trainers complete some additional training in order to deliver this ‘condensed’ one-day course which is what RMG is delivering.

1700 Royal Mail Group employees have so far attended the RMG delivered MHFA courses – mainly managers. Approximately 10% are front line CWU grades, CWU Reps and Mental Health Ambassadors.

Course Dates for the first quarter period January – March 2020 have now been released and applications are invited from Physical/Medical First Aiders and CWU Area Health and Safety Reps to attend the 1-day Mental Health First Aid Courses at the venues and at the times in the table listed below. CWU Members who are Mental Health Ambassadors can also apply to attend.
