Introduction

Air pollution in the UK is a public health emergency and has rightly in recent times become the centre of attention as the government’s own figures confirm that air pollution is responsible for 40,000 deaths in the UK each year and the World Health Organisation has called it a global health emergency. Workers are exposed to and create pollution to fulfil contractual obligations to employers. It is an occupational health issue that employers take little responsibility for. The ‘Greener Jobs Alliance’ and the ‘Hazards Campaign’ are offering this free half day courses for trade union representatives to look in detail at the issue and explores what can be done about it.  

The Greener Jobs Alliance

The Greener Jobs Alliance (GJA) has been formed as a partnership body inclusive of trade unions, student organisations, campaigning groups and a policy think tank. It campaigns around the issue of jobs and the skills needed to transition to a low-carbon economy. The founding members of the GJA are the University and College Union, Trades Union Congress, Greenpeace, Friends of the Earth, National Union of Students, People & Planet, and the Institute of Public Policy Research.

The CWU has again decided to run a digital photography competition as part of our informal learning project. This competition is open to all CWU members and their families. Last year’s winner was, Tim El Shawk who is a member of the Gloucestershire Amal Branch.

Our Learning Reps have enabled hundreds of our members to undertake Digital Photography courses. The opportunities offered by mobile and smart phones mean that many of our members have a digital camera in their pocket to record the world around them. This is an exciting opportunity for our members to share their skills and abilities and I encourage members and their families to take part.

The winning entries will be judged to be the most visually appealing interpretations of the brief, capturing on camera the spirit of the chosen theme and their overall impact and composition. Digital manipulation is acceptable but not necessary. To assist our judges please add a short explanation of how and why the photo was taken.

CWU Health, Safety & Environment Department Response to “Government Deregulation Agenda Inquiry” – Health and Safety Legislation and Enforcement:

The House of Commons Regulatory Reform Select Committee is carrying out an inquiry into the effectiveness of the Tory Government’s deregulation agenda.

The scope of the Select Committee of MPs Inquiry will be to consider the Government’s approach to reducing the burden on business and civil society of regulation, by examining the volume and breadth of regulations and burdens on business, the effectiveness of the regulatory framework within Government and the use of post-implementation reviews.

In line with well-established Conference Policy, the Health, Safety and Environment Department has submitted a response to the Inquiry’s public consultation process, specifically on the ‘negative’ effects and impact of the deregulation agenda on health and safety at work and in general in the UK which prioritises business interests and profits over worker and public safety.

Our response concludes by making a number of recommendations, key to which is our call for an end to health and safety deregulation and instead that health and safety law enforcement is regenerated and reinforced as well as refocusing attention on industries like communications which were wrongly categorised as ‘low risk’ by the government as well as providing fit for purpose protection for vulnerable workers in the modern day, increasingly fragmented workplace. Additionally the CWU is calling for the current regulatory approach that put business interests and profits before worker and public safety to be ended and that Trade Unions Safety Reps are given new strengthened rights and powers and provided with increased involvement in health and safety decisions, including powers to stop work that presents an immediate danger.

In March 2016 the then Business Minister Sajid Javid told British Business Bosses that the government remains more committed than ever to ‘cutting regulation and red tape’ and reducing overall levels of regulation, telling the Bosses and Industry Moguls that the Tories had already cut £10 billion pounds worth of regulation ‘red tape’ but regulation remains too high and that the Tory Government is going to reduce the regulatory burden still further by cutting the cost of regulation by another £10 billion, as well as weakening the way statutory regulators enforce regulatory rules. He announced that in future, for every £1 pound of regulatory burden the government created, £3 pounds worth had to be removed!

In June 2017, the Grenfell Tower fire disaster occurred killing 71 people. Survivors stated that their repeated concerns about the risk of fire at the building in the months before the fatal blaze were simply “brushed away” by Kensington and Chelsea council officials. The Grenfell Tenants Action Group warned of “dangerous living conditions” and said: “It’s a terrifying thought but only a catastrophic event will expose the ineptitude and incompetence of the Council.

Following the blaze Tory Prime Minister Theresa May said “there would be a thorough fire-safety regulation review of all buildings similar to Grenfell Tower”.

In December 2017, Dame Judith Hackitt, former Chair of the UK Health and Safety Executive, and now the Chair of the independent review into building regulations and fire safety said she was “shocked” by some of the practices she had seen, calling for better enforcement to “hold to account those who try to cut corners.” In her interim investigation report she stated that “A universal shift is required to significantly improve fire safety. The current system is not fit for purpose and government must address the ‘shortcomings’ identified.”

As you may be aware, the Labour Party is hosting a festival of music, arts and politics called Labour Live in London on Saturday 16th June.

The event will feature music acts such as Rae Morris, the Magic Numbers and Jermain Jackman; political speakers including Jeremy Corbyn, Owen Jones and Alex Nunns; and a range of other activities from activist training to kids’ entertainment.

The CWU has around 400 free tickets for our members and their families which are available on a first come first served basis until Friday 8th June.

New RMG Policy

This is to inform all CWU Postal Branches, Regions and Regional Health and Safety Committees that Mark Bromhall Royal Mail Group Road Safety Manager has informed the Unions (CWU and Unite/CMA) that the Royal Mail Group Board have approved the proposal to prohibit the use of mobile devices, including ‘hands-free’ whilst driving. The policy change will apply to anybody driving for Royal Mail regardless of role or rank within the business and will include all vehicles including cars. The new policy takes effect from Monday 18th June.

Background To RMG Decision on New Policy

Given the statistics around the impact of mobile device distractions on road casualties, Royal Mail Group has concluded that this is an important step in keeping all of its employees safe and reflects advice provided to Royal Mail Group by organisations such as:-

• RoSPA,

• The Institute of Advanced Motorists

• Brake (Road Safety Charity) and

• RoadPeace (Road Crash Victims Charity).

‘Driver distraction impairs control of the vehicle, reduces awareness of what is happening on the road and, through reducing concentration on the task of driving, can contribute to causing an incident or collision.

Research into the causes of driver distraction has identified that both hands free and hand operated use of electronic devices are significant contributors to driver distraction. Research has also shown that drivers are more likely to be involved in a collision whilst using a ‘Hands-Free’ phone and they can cause almost the same level of risk as driving whilst using a hand-held phone. Studies also show that a driver’s reaction time when using a hands free kit can be even slower than when drink driving. If a driver is texting whilst driving, that risk increases dramatically.’

In 2017 a coalition of road safety charities and organisations launched a campaign to prevent distracting alerts while driving. The coalition warned that urgent action is needed to tackle “the needless deaths and serious injuries caused by drivers using ‘hand-held’ mobile phones behind the wheel and called for new phone systems to include a ‘Do Not Disturb While Driving’ mode that detects when someone is driving and turns off calls plus text messages and notifications. The coalition included Brake, RAC, Brighton and Hove City Council, the Parliamentary Advisory Council on Transport Safety, RED Driving School, Road Safety GB and RoadPeace. The charities and organisations also support the law being extended to ban all mobile phone use in the car, including ‘Hands-Free’ as no phone call or text is worth a life – they say. The group said that the illegal use of hand held mobile phones at the wheel is now at “epidemic proportions”, with an estimated 11 million UK motorists admitting to making or receiving a call while driving and a shocking five million saying they have taken photos or videos while at the wheel of a moving vehicle.

In a tragic, landmark legal case in December 2017, a driver using a ‘hands-free’ device during an “in-depth chat” with a friend, crashed into and killed a motorcyclist. At Lincoln Crown Court, driver Samantha Ayres was jailed for 3 years after she was found guilty of causing death by dangerous driving. The judge John Pini QC also branded ‘hands-free phones’ used behind the wheel as “dangerous”.

In January 2018, Police forces across England and Wales launched a national crack down on drivers using their phones behind the wheel.

Safety No1 Priority

In launching the new Policy, Royal Mail Group has repeated that employee health and safety is the number one priority.

The Law

Whilst UK driving law does not forbid the use of mobiles devices ‘hands-free’, it does say that drivers must not be distracted whilst driving. If a driver is using a device, even hands-free, their attention can be distracted, and even a moment’s distraction can cause accidents, with devastating consequences.

Although it’s an offence to be seen using a hand held phone, regardless of whether driving has been affected, this is not the case for hands-free phones. Drivers judged not to be in control of a vehicle while using a hands-free phone can be prosecuted for that offence and receive a fine and penalty points.

Drivers distracted by a mobile device which affects their standard of driving can also be prosecuted for Careless or Dangerous Driving. Where a crash results that causes serious injuries or death, a prison sentence is normally handed down by the courts. Please also be aware that the ‘hands-free’ use of mobile phones can be, and is, used as evidence to support convictions for careless or dangerous driving, including the very serious charge of causing death by dangerous driving. Sentences for causing death by dangerous driving include a custodial sentence to a maximum of 14 years (See attached Example Cases).

Employers can also be prosecuted if they cause or permit a driver to drive while using a phone or to not have proper control of the vehicle, if they require a driver to make or receive calls whilst driving or if their drivers drive dangerously because they’re using a phone installed/provided by the employer.

RMG SHE Standards 11.4 and 11.8
See attached copies of the new amended versions of Royal Mail Group’s Safety, Health and Environment Standards 11.4 and 11.8. These state that employees must; Never use a mobile phone, PDA other mobile device or anything else likely to cause a distraction whilst driving. This includes the use of devices via Bluetooth or other ‘hands-free’ connectivity whether for the purposes of making & receiving calls, sending or receiving messages via text, email or any other format, or the use of the internet, social media or any other similar application. Satellite Navigation devices should be programmed before commencing a journey and never programmed whilst driving. Those making a call to a Royal Mail employee must terminate any call immediately where they identify that the employee is driving.
